1. About these terms

Kervos Poker is an Australian business selling premium poker sets and custom poker chips to Australian and international customers. These terms cover use of kervospoker.com and purchases from Kervos Poker. Please read them alongside the policies presented at checkout and any written terms agreed for your custom order.

These terms do not replace the existing Shopify checkout policies or change agreed shipping arrangements. Mandatory consumer rights take priority. Subject to those rights, specific written order terms and the applicable checkout policies govern any inconsistency with these general terms.

2. Orders and acceptance

Placing an order is an offer to purchase. An order is accepted when Kervos Poker confirms acceptance, after payment has been received and processed. Please provide accurate contact, billing and delivery details and check your selection before submitting an order.

Orders remain subject to availability and the applicable checkout terms. If an order cannot be fulfilled, or an error affects it, we will contact you about the available options and refund any payment for goods we do not supply. Contact us promptly to request a change or cancellation; requests may not be possible after acceptance or dispatch. This does not limit statutory cancellation or refund rights.

3. Prices and payments

Payments are processed through our existing Shopify checkout using the payment methods offered there. The applicable currency, product prices, discounts, shipping charges and tax treatment are those disclosed for your order at checkout and in your order confirmation. No additional payment method or fee is introduced by these terms.

You must be authorised to use the payment method supplied. Your payment provider may apply its own currency conversion or processing charges. Any applicable customs duties, import taxes or clearance charges are governed by the disclosures for your order and local law.

4. Shipping and international delivery

Available destinations, delivery options and shipping charges are determined by our existing shipping arrangements and the options offered at checkout or in your accepted custom quote. These terms do not promise delivery to every country, free shipping or a fixed dispatch time.

Unless expressly agreed otherwise, delivery times are estimates. Carrier services, customs processing and events outside our reasonable control may affect delivery. Please contact us if your parcel is delayed, lost, damaged or incorrectly delivered so we can investigate and provide any remedy required by law. Nothing here transfers or excludes responsibilities that cannot lawfully be transferred or excluded.

International customers should check local import requirements. Responsibility for any additional charges is as disclosed for the order and required by applicable law.

5. Returns, exchanges and refunds

Our existing refund policy governs voluntary returns and exchanges. It currently allows return requests within 30 days of receipt for eligible items in their original condition, unused, with tags and original packaging, together with proof of purchase. Contact us before sending anything back; we will provide the return instructions and address. Do not send a return to an unconfirmed address.

The policy excludes custom or personalised products, sale items and gift cards from voluntary returns. Those exclusions, packaging requirements and time limits do not restrict remedies for faulty, damaged, misdescribed or otherwise non-compliant goods under applicable consumer law.

Under the existing policy, approved refunds are made to the original payment method within 10 business days after approval following inspection. Your payment provider may take additional time to post the refund. Contact us if more than 15 business days have passed since approval. Where the law requires a different remedy or timeframe, that law applies.

Our existing policy also provides a 14-day cooling-off period for merchandise shipped into the European Union. Any mandatory cancellation rights, lawful exceptions and additional protections applicable in your country remain unaffected.

6. Custom poker chips and personalised orders

Custom orders are quoted individually. The accepted written quote and correspondence specify the design, quantities, price, payment arrangements and delivery expectations. Please check artwork, colours, spelling and denominations carefully and raise any changes before approving the design.

Changes or cancellation after approval may not be possible once manufacturing has begun; any applicable conditions must be disclosed and agreed for your order. These general terms do not introduce a deposit, minimum order quantity, cancellation charge or new production deadline.

You confirm that you own, or have permission to use, any artwork, logos or other material you provide. You permit Kervos Poker and its production partners to use that material only as needed to fulfil your order. Custom goods retain all applicable consumer guarantees, notwithstanding the voluntary-return exclusion.

7. Australian consumer protections

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot be excluded by agreement.

Where the Australian Consumer Law applies, our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

These protections apply to eligible custom products as well as standard products. A change-of-mind policy does not remove them. International customers also retain any mandatory protections that apply to their purchase.

8. Intellectual property

Kervos Poker branding, product designs, photographs, text and other website materials belong to Kervos Poker or their respective owners and are protected by intellectual property law. Purchasing a product does not transfer intellectual property rights. Except as permitted by law or with the owner's permission, you must not copy, distribute or commercially exploit protected material. Customer-supplied artwork remains the property of its owner.

9. Website use and third-party services

Use this website lawfully and do not interfere with its security, misuse other people's information or submit unlawful or infringing content. Third-party services, including Shopify and payment providers, may have their own terms and privacy practices. Their involvement does not remove Kervos Poker's obligations to you as the seller.

10. Liability

Our responsibility for your purchase is governed by applicable law, these terms and the applicable order policies. We do not guarantee uninterrupted website availability. Any exclusion or limitation in an applicable policy operates only to the extent permitted by law. Nothing excludes liability for matters that cannot lawfully be excluded, or limits your rights to a statutory remedy or compensation.

11. Applicable law and changes

These terms are intended to operate under applicable Australian law, subject to mandatory consumer protections and any governing-law provision in the applicable checkout terms that is valid and enforceable. Nothing requires you to give up access to a court or dispute-resolution body available under mandatory law.

Any future revision will state its effective date. Changes will not retrospectively remove rights relating to an existing order. These terms take effect on 18 October 2026.
